The law notwithstanding, XKeyscore could allow the NSA to target US persons without a warrant. However that restriction does not apply when communication is between a US person and a foreign target. US law prohibits the NSA from surveilling "US persons" - American citizens or people on US soil - without a warrant from the secret FISA (Foreign Intelligence Surveillance Act) court. NSA agents need no prior authorization for using the program, and only have to fill out a simple search form, including a general justification to conduct the search. One of the most noteworthy aspects of XKeyscore is the broad degree of freedom the program's users have in searching all the data.
